Understanding The Basic Requirements For Social Security Disability (SSD)

When you apply for benefits, the first thing the Administration will want to know is whether you have paid enough taxes into the system. In the past 10 years, you must have paid taxes for at least five. (If you have not, you may still be able to obtain Supplemental Security Income (SSI) benefits.)

If you meet the tax requirements, the Administration will then need you to prove that your condition prevents you from holding any type of job. Many types of disabling diseases and conditions may make you eligible for benefits, as long as it is impossible for you to work.

Finally, you must apply for benefits within five years of the time you stopped working. This means you should contact a lawyer as soon as possible.

Are You Eligible For Supplemental Security Income (SSI)?

The Administration determines eligibility for SSI in much the same way that it does for SSD, which means that you must have a disabling condition that prevents you from working for at least a year. Our law firm can help you understand if your physical condition, mental condition or even the medications you're taking may allow you to qualify.

If you have a disabling condition that makes it impossible to work, the Administration will then need proof that you meet the income restrictions. Because SSI is a welfare-based program, your household must have less than a certain amount of assets and income for you to qualify.
